PARTICIPATION & VOLUNTARY CONSENT
I voluntarily choose to participate in any activities, programs, events, services, retreats, ceremonies, spa or wellness services, lodging, rentals, volunteering, or general use of the land and facilities of Tierra Encantada – Inversiones El Jilguero LTDA. including its owners, directors, officers, employees, agents, volunteers, facilitators, and contractors (“Tierra Encantada”). Participation is optional, and I may stop at any time.

ASSUMPTION OF RISK
I understand that activities at Tierra Encantada involve inherent risks, including but not limited to physical exertion, outdoor terrain, wildlife, insects, weather conditions, natural features, emotional or psychological experiences, use of structures, spa services, and remote location factors. I knowingly and voluntarily assume all such risks, whether foreseeable or unforeseeable.

LODGING & NATURAL ENVIRONMENT
I understand that Tierra Encantada is located in a natural environment and that lodging and facilities may involve uneven terrain, humidity, insects, animals, limited services, power or water interruptions, and other conditions inherent to eco-based properties.

HEALTH & MEDICAL RESPONSIBILITY
I confirm that I am physically, mentally, and emotionally capable of participation. Tierra Encantada is not a medical facility. I understand that the nearest clinic is approximately 45 minutes away and the nearest hospital is approximately 3 hours away. In the event of injury or illness, I authorize Tierra Encantada to seek reasonable assistance on my behalf and agree that I am solely responsible for any medical expenses incurred.

SPA & WELLNESS SERVICES
I understand that spa and wellness services are provided for relaxation and well-being only and do not constitute medical treatment. I voluntarily consent to touch where applicable, agree to disclose relevant health conditions, and accept responsibility for my participation.

RELEASE OF LIABILITY
To the fullest extent permitted under Costa Rican law, I release and discharge Tierra Encantada from any and all claims, demands, or causes of action arising from my participation or presence on the property, including claims based on ordinary negligence, excluding gross negligence or intentional misconduct.

COVENANT NOT TO SUE
I agree not to initiate or participate in any lawsuit or legal proceeding against Tierra Encantada related to my participation, except where such waiver is prohibited by law.

INDEMNIFICATION
I agree to indemnify and hold harmless Tierra Encantada from any claims, damages, or expenses (including reasonable legal fees) arising from my actions, conduct, or failure to follow rules or instructions.

RULES & CONDUCT
I agree to follow all reasonable safety rules, guidelines, and instructions and to act respectfully toward others, the property, and the natural environment.

LEGAL CAPACITY & UNDERSTANDING
I confirm that I am at least 18 years of age, have read and understood this agreement, and sign it voluntarily without coercion.

GOVERNING LAW & JURISDICTION
This agreement shall be governed by and interpreted in accordance with the laws of the Republic of Costa Rica, and any dispute shall be submitted to the competent courts of Costa Rica.

SEVERABILITY
If any provision of this agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

PARTICIPACIÓN Y CONSENTIMIENTO VOLUNTARIO
Participo voluntariamente en cualquier actividad, programa, evento, retiro, ceremonia, servicio de spa o bienestar, hospedaje, alquiler, voluntariado o uso general del terreno e instalaciones de Tierra Encantada – Inversiones El Jilguero LTDA. incluyendo a sus propietarios, directores, funcionarios, empleados, agentes, voluntarios, facilitadores y contratistas (en adelante, “Tierra Encantada”). Mi participación es opcional y puedo retirarme en cualquier momento.

ASUNCIÓN DE RIESGO
Entiendo que las actividades en Tierra Encantada implican riesgos inherentes, incluyendo, entre otros, esfuerzo físico, terreno natural, fauna, insectos, condiciones climáticas, características naturales, experiencias emocionales o psicológicas, uso de estructuras, servicios de spa y ubicación remota. Asumo voluntariamente todos dichos riesgos, sean previsibles o no.

HOSPEDAJE Y ENTORNO NATURAL
Reconozco que Tierra Encantada se encuentra en un entorno natural y que el hospedaje e instalaciones pueden implicar terreno irregular, humedad, insectos, animales, servicios limitados, interrupciones de agua o electricidad y otras condiciones propias de propiedades ecológicas.

SALUD Y RESPONSABILIDAD MÉDICA
Confirmo que estoy física, mental y emocionalmente apto(a) para participar. Tierra Encantada no es un centro médico. Entiendo que la clínica más cercana se encuentra aproximadamente a 45 minutos y el hospital más cercano a aproximadamente 3 horas. Autorizo a Tierra Encantada a buscar asistencia razonable en caso de emergencia y acepto ser responsable de cualquier gasto médico.

SERVICIOS DE SPA Y BIENESTAR
Entiendo que los servicios de spa y bienestar se ofrecen únicamente con fines de relajación y bienestar y no constituyen tratamiento médico. Doy mi consentimiento voluntario al contacto físico cuando aplique y me comprometo a informar cualquier condición de salud relevante.

EXENCIÓN DE RESPONSABILIDAD
En la máxima medida permitida por la legislación costarricense, libero y exonero a Tierra Encantada de toda responsabilidad, reclamación o demanda derivada de mi participación o permanencia en el lugar, incluyendo negligencia ordinaria, excepto en casos de negligencia grave o conducta dolosa.

COMPROMISO DE NO DEMANDAR
Acepto no iniciar ni participar en ninguna acción judicial o legal contra Tierra Encantada relacionada con mi participación, salvo en los casos en que la ley lo prohíba.

INDEMNIZACIÓN
Acepto indemnizar y mantener indemne a Tierra Encantada frente a cualquier reclamación, daño o gasto (incluidos honorarios legales razonables) derivados de mis actos, conducta u omisiones.

NORMAS Y CONDUCTA
Me comprometo a cumplir todas las normas razonables de seguridad, instrucciones y lineamientos, y a comportarme de manera respetuosa con las personas, las instalaciones y el entorno natural.

CAPACIDAD LEGAL Y COMPRENSION
Confirmo que soy mayor de 18 años, que he leído y comprendido este acuerdo, y que lo firmo de manera libre y voluntaria.

LEY APLICABLE Y JURISDICCION
Este acuerdo se regirá e interpretará conforme a las leyes de la República de Costa Rica y cualquier controversia será sometida a los tribunales competentes de Costa Rica.

DIVISIBILIDAD
Si alguna disposición de este acuerdo fuese declarada inválida o inaplicable, las demás disposiciones permanecerán en pleno vigor.

PARTICIPATION ET CONSENTEMENT VOLONTAIRE
Je participe volontairement à toute activité, programme, événement, retraite, cérémonie, service de spa ou de bien-être, hébergement, location, bénévolat ou usage général du terrain et des installations de Tierra Encantada – Inversiones El Jilguero LTDA, y compris ses propriétaires, administrateurs, dirigeants, employés, agents, bénévoles, facilitateurs et sous-traitants (ci-après « Tierra Encantada »). Ma participation est facultative et je peux me retirer à tout moment.

ACCEPTATION DES RISQUES
Je comprends que les activités proposées à Tierra Encantada comportent des risques inhérents, notamment, sans s’y limiter, l’effort physique, le terrain naturel, la faune, les insectes, les conditions climatiques, les caractéristiques naturelles, les expériences émotionnelles ou psychologiques, l’utilisation de structures, les services de spa et l’éloignement du site. J’assume volontairement l’ensemble de ces risques, qu’ils soient prévisibles ou non.

HÉBERGEMENT ET ENVIRONNEMENT NATUREL
Je reconnais que Tierra Encantada est situé dans un environnement naturel et que l’hébergement et les installations peuvent comporter un terrain irrégulier, de l’humidité, des insectes, des animaux, des services limités, des interruptions d’eau ou d’électricité, ainsi que d’autres conditions propres aux propriétés écologiques.

SANTÉ ET RESPONSABILITÉ MÉDICALE
Je confirme être physiquement, mentalement et émotionnellement apte à participer. Tierra Encantada n’est pas un établissement médical. Je comprends que la clinique la plus proche se trouve à environ 45 minutes et l’hôpital le plus proche à environ 3 heures. J’autorise Tierra Encantada à rechercher une assistance raisonnable en cas d’urgence et j’accepte d’assumer la responsabilité de tous les frais médicaux encourus.

SERVICES DE SPA ET DE BIEN-ÊTRE
Je comprends que les services de spa et de bien-être sont offerts uniquement à des fins de relaxation et de bien-être et ne constituent pas un traitement médical. Je donne mon consentement volontaire au contact physique lorsque cela s’applique et je m’engage à informer de toute condition de santé pertinente.

EXONÉRATION DE RESPONSABILITÉ
Dans toute la mesure permise par la législation costaricienne, je libère et exonère Tierra Encantada de toute responsabilité, réclamation ou action découlant de ma participation ou de ma présence sur le site, y compris en cas de négligence ordinaire, sauf en cas de négligence grave ou de faute intentionnelle.

ENGAGEMENT DE NON-POURSUITE
J’accepte de ne pas engager ni participer à une action judiciaire ou légale contre Tierra Encantada en lien avec ma participation, sauf dans les cas où la loi l’interdit.

INDEMNISATION
J’accepte d’indemniser et de dégager de toute responsabilité Tierra Encantada contre toute réclamation, tout dommage ou toute dépense (y compris les honoraires juridiques raisonnables) résultant de mes actes, de mon comportement ou de mes omissions.

RÈGLES ET CONDUITE
Je m’engage à respecter toutes les règles de sécurité raisonnables, les instructions et les directives, et à me comporter de manière respectueuse envers les personnes, les installations et l’environnement naturel.

CAPACITÉ JURIDIQUE ET COMPRÉHENSION
Je confirme être âgé(e) de plus de 18 ans, avoir lu et compris le présent accord et le signer librement et volontairement.

LOI APPLICABLE ET JURIDICTION
Le présent accord est régi et interprété conformément aux lois de la République du Costa Rica, et tout litige sera soumis aux tribunaux compétents du Costa Rica.

DIVISIBILITÉ
Si l’une des dispositions du présent accord est déclarée invalide ou inapplicable, les autres dispositions demeureront pleinement en vigueur.
